Description

PCT/IB/313, NOTIFICATION OF DEFECTS IN THE INTERNATIONAL APPLICATION (PCT Articles 3(4)(i) and 14(1) and Rule 28.1). This form is a specific notification issued by the International Bureau of the World Intellectual Property Organization (WIPO) to the applicant of an international patent application when defects are identified in the application. The defects may relate to the content or form of the application. PCT Article 3(4)(i) requires the receiving Office to examine the international application to determine whether it meets the minimum requirements of the PCT. If defects are identified, the receiving Office must notify the applicant and give them an opportunity to correct the defects within a specified time limit. PCT Article 14(1) requires the International Bureau to carry out a formalities examination of the international application. If defects are identified, the International Bureau must notify the applicant and give them an opportunity to correct the defects within a specified time limit. Rule 28.1 of the PCT Regulations provides further details on the content and form of the notification of defects, including the specific defects identified and the time limit for correcting them. Therefore, PCT/IB/313 is a formal communication from the International Bureau to the applicant of an international patent application notifying them of defects identified during the formalities examination. The notification will detail the specific defects identified, and the applicant will be given a specified time limit within which to correct the defects to ensure that the application meets the minimum requirements of the PCT. www.FormsWorkflow.com
