Description

PCT/IB/373, INTERNATIONAL PRELIMINARY REPORT ON PATENTABILITY (Chapter I of the Patent Cooperation Treaty) (PCT Rule 44bis). The report provides a preliminary assessment of the patentability of the invention claimed in the application based on the claims, the description, and any drawings included in the application. The IPRP includes a written opinion on the patentability of the invention and a report on the prior art that has been considered in reaching that opinion. The written opinion may indicate whether the invention is novel, involves an inventive step, and is capable of industrial application, and may identify any potential issues that may arise during the examination process. The IPRP is typically issued after the international search report (ISR) has been prepared and may be requested by the applicant or automatically prepared by the IPEA. If the IPRP is issued by the IPEA, it may also include an indication of whether any amendments to the application are necessary to address any issues identified in the report. PCT/IB/373 provides instructions on the content and format of the IPRP, as well as the procedures for its issuance and transmission to the applicant or their representative. The report serves as an important tool for the applicant in deciding whether to continue with the application and to which designated offices to enter the national phase. It is important to note that the IPRP is not binding on the designated offices in which the applicant seeks protection, and each designated office may conduct its own examination of the application. However, the IPRP provides valuable information and guidance for the applicant and may increase the chances of a successful application. www.FormsWorkflow.com
