FORM 8.2 - ELECTION OF SURVIVING SPOUSE TO TAKE AGAINST WILL. This form is used in the Stark County Probate Court by the surviving spouse of a deceased individual to formally declare their decision to take against the decedent’s will, as permitted under Ohio Revised Code Sections 2106.01 and 2106.06. By submitting this election, the surviving spouse chooses to reject the provisions made for them in the will and instead claim the statutory share of the estate to which they are entitled by law. The form confirms that the contents of the will, the spouse’s rights under it, and the legal consequences of taking against the will have been explained and understood. The election must be made in person before the probate judge, who certifies that a full explanation was provided before accepting the decision.
