FORM 2.0 - APPLICATION TO PROBATE WILL. This form is used in the Probate Court of Stark County, Ohio, when an individual submits a deceased person's will for probate. Under R.C. 2107.11, 2107.18, and 2107.19, this form is necessary to initiate the legal process of validating the will and appointing an executor to administer the estate. The applicant provides details about the decedent, including their date of death and last known domicile. A copy of the purported will is attached for review by the court. The applicant may also waive notice of probate, meaning they forgo the formal notification that the will is being probated. Additionally, the form requires a list of the decedent’s surviving spouse, children, next of kin, and beneficiaries, which is submitted using an attached Form 1.0. If all parties entitled to notice sign the Waiver of Notice of Probate of Will, they agree that they do not require formal notice, which can expedite the process. Otherwise, the court will require proof that notice has been given to interested parties. Once the court determines that the will complies with legal requirements, it issues an Entry Admitting Will to Probate, officially recognizing the will and ordering it to be recorded.
