FORM 5.10 - APPLICATION FOR SUMMARY RELEASE FROM ADMINISTRATION [R.C.2113.031]. This form is used in the Probate Court of Stark County, Ohio, to request a simplified process for settling a small estate without going through full probate administration. This form is applicable when the estate meets specific criteria outlined in R.C. 2113.031. It is typically used by a surviving spouse or another individual responsible for paying the decedent’s funeral and burial expenses. If the applicant is the surviving spouse, they must be entitled to the full statutory allowance for support of $40,000, and the estate’s total value cannot exceed that amount plus an additional $5,000 for funeral expenses. If the applicant is not the surviving spouse, they must have paid or be obligated to pay the funeral expenses, and the estate’s total value must be the lesser of $5,000 or the actual funeral costs.
