FORM 7.2 - APPLICATION FOR APPORTIONMENT OF FAMILY ALLOWANCE [R.C. 2106.13 (B)(3) AND (4)]. This form is used in the Stark County, Ohio Probate Court when an estate is being administered for a deceased individual who either has a surviving spouse and minor children not belonging to that spouse, or has no surviving spouse but more than one minor child. In such cases, the fiduciary (such as the executor or administrator of the estate) uses this form to request that the court issue an order apportioning the statutory family allowance among the eligible survivors. The form collects details about the surviving spouse and minor children, including names, addresses, dates of birth, and custody information. Upon filing, the court sets a hearing date and orders notice to be given to all interested parties. After reviewing the circumstances, the judge may issue an Entry on Apportionment, outlining how the family allowance and any applicable property (such as a second automobile selected by the spouse) are to be distributed among the spouse and/or children.
