FORM 13.0 - FIDUCIARY'S ACCOUNT. This form is used in the Probate Court of Stark County, Ohio, for a fiduciary's account, which is a financial report submitted by the executor or administrator of a decedent’s estate. It is required under Ohio Revised Code (R.C.) 2109.30, 2109.301, and 2109.32 and provides a detailed statement of receipts and disbursements made by the fiduciary while managing the estate. The fiduciary requests that the account be approved and settled by the court. Depending on the stage of estate administration, the form can be used for different types of accounts, such as a partial account (showing assets remaining in the fiduciary’s hands), a final account (outlining the assets ready for distribution to beneficiaries), an account of distribution (requesting discharge upon approval), or a supplemental final account (providing additional financial details). The document includes a recapitulation of receipts and disbursements, showing income, sales proceeds, administrative expenses, attorney and fiduciary fees, debts paid, taxes, and distributions to beneficiaries. If a distributee has received an asset from the estate and a valid claim arises later, they may be required to return part or all of the distribution as per R.C. 2117.06(K). Additionally, R.C. 2109.32(C) states that individuals with a financial interest in the estate retain their rights even after the account’s approval, unless a formal hearing is held under R.C. 2109.33.
