FORM 4.3 - WAIVER OF RIGHT TO ADMINISTER. This form is used in the Stark County, Ohio Probate Court when multiple individuals have an equal or higher priority to administer a decedent’s estate but choose to waive their right in favor of another applicant. Under Ohio probate law, certain individuals, such as a surviving spouse or next of kin, have priority in being appointed as the executor (if there is a will) or administrator (if there is no will).
