Description

PCT/RO/155, NOTIFICATION THAT DEMAND CONSIDERED NOT TO HAVE BEEN SUBMITTED (PCT Rule 59.3(d) and (f)). This form is used by the receiving office (RO) to notify the applicant that the demand for international preliminary examination (IPEA) is considered not to have been submitted under PCT Rule 59.3(d) and (f). The form typically indicates that the demand is considered not to have been submitted because the applicant has failed to furnish within the time limit set forth in the invitation (Form PCT/RO/154) the indication of the competent International Preliminary Examining Authority (IPEA) to which the demand should have been transmitted. In other words, the applicant has not identified a specific IPEA to conduct the international preliminary examination within the time limit set by the RO. As a result, the RO will refund any amount paid by the applicant in respect of the demand. It is important for the applicant to carefully follow the instructions provided by the RO and to timely respond to any invitations or requests for information to ensure that the application is properly processed.
