PCT/RO/147, NOTIFICATION CONCERNING FAILURE TO FORWARD RECORD COPY AND SEARCH COPY FOR NATIONAL SECURITY REASONS (Rules 15.6(iii), 16.2(iii) and 22.1(a) and PCT Administrative Instructions, Section 330). This form is used in the context of international patent applications filed under the Patent Cooperation Treaty (PCT) and is used by the receiving office (RO) to notify the applicant that, due to reasons of national security, this application is and will not be treated as an international application. According to PCT Rule 15.6(iii), Rule 16.2(iii), and Rule 22.1(a), the applicant is required to submit a record copy and a search copy of the international application to the ISA and IPEA, respectively, unless the RO indicates that it cannot do so for national security reasons. In such cases, the RO must notify the IB of the reasons why the copies cannot be forwarded.
