PCT/RO/158, NOTIFICATION OF INTENDED REFUSAL OF REQUEST TO RESTORE RIGHT OF PRIORITY AND/OR INVITATION TO FURNISH DECLARATION OR OTHER EVIDENCE (PCT Rule 26bis.3(f) and (g)). This form is a notification issued by the International Searching Authority (ISA) or International Preliminary Examining Authority (IPEA) in accordance with PCT Rule 26bis.3(f) and (g). This notification informs the applicant that their request to restore the right of priority has been refused, and/or invites the applicant to furnish a declaration or other evidence in support of their request. Under PCT Rule 26bis.3, an applicant who fails to file a PCT application within the 12-month priority period may, under certain circumstances, request the restoration of the right of priority. If the ISA or IPEA finds that the request does not meet the requirements for restoration of the right of priority, or if the applicant fails to respond to a request for additional information or evidence, the ISA or IPEA may issue a notification of intended refusal, such as PCT/RO/158. If an applicant receives PCT/RO/158, they should carefully review the reasons for the refusal and/or the requirements for furnishing a declaration or other evidence, and take appropriate action to address the issues raised by the ISA or IPEA. Failure to respond to PCT/RO/158 may result in the loss of the right of priority and the rejection of the PCT application. www.FormsWorkflow.com
