FORM 8.1 - ELECTION OF SURVIVING SPOUSE TO TAKE UNDER WILL. This form is used in the Stark County Probate Court by the surviving spouse of a deceased individual to formally declare their decision to take under the decedent’s will, as authorized by Ohio Revised Code Section 2106.05. By submitting this election, the surviving spouse chooses to accept the provisions set forth in the decedent’s will, rather than exercising the option to take an elective share (which would be available if they chose to take against the will).
