Description

FORM 5.6 - ENTRY RELIEVING ESTATE FROM ADMINISTRATION. This form is used in the Probate Court of Stark County, Ohio, to relieve an estate from administration under Ohio Revised Code (R.C.) 2113.03. It allows for a streamlined process for small estates, eliminating the need for full probate administration. The court reviews the application and confirms that the decedent’s assets do not exceed statutory limits, that the date of death and domicile are correct, and that proper notice has been given or waived. Based on this, the court orders specific actions, which may include selling personal property, paying debts, distributing a statutory family allowance to a surviving spouse or minor children, issuing a Certificate of Transfer for real estate, and authorizing financial institutions to release funds. If necessary, the court may also appoint a commissioner to handle the distribution or sale of personal property, including titled assets like vehicles or watercraft. The commissioner is required to complete the process and report back to the court within 60 days. www.FormsWorkflow.com
