Description

FORM 4.0 - APPLICATION FOR AUTHORITY TO ADMINISTER ESTATE [R.C. 2109.02 and 2109.07]. This form is used in the Probate Court of Stark County, Ohio, by an individual seeking appointment as the executor or administrator of a deceased person's estate. This form is required whether the decedent left a will (testate) or did not leave a will (intestate). The applicant provides details about the decedent’s domicile at the time of death, the estimated value of the estate, and any debts owed to or by the estate. The form also includes options for requesting a waiver of bond if the will specifies no bond is required, if the applicant is the surviving spouse or next of kin entitled to the full estate, or if the applicant is a trust company exempt by law. If applicable, the applicant must acknowledge their fiduciary duties and potential legal consequences for mismanaging estate assets. If other individuals have an equal or superior right to administer the estate, they may sign a Waiver of Right to Administer, allowing the applicant to proceed. The court then sets a hearing date to review the application and notify any individuals entitled to administer the estate who have not waived their rights. If approved, the applicant is granted the legal authority to manage the estate’s assets, pay debts, and distribute remaining assets to heirs or beneficiaries. www.FormsWorkflow.com
