FORM 2.1 - WAIVER OF NOTICE OF PROBATE OF WILL. This form is used in the Stark County, Ohio Probate Court to allow individuals entitled to notice of the probate of a will to formally waive their right to receive such notice. Under Ohio Revised Code 2107.19(A)(2), when a will is admitted to probate, certain individuals—such as heirs, beneficiaries, and next of kin—must be notified of the probate proceedings. By signing this waiver, those individuals acknowledge the probate process but choose to forgo official notice. Once the court files a certificate confirming the waivers and any required notices, the timeframe to contest the validity of the will is limited. For estates of decedents who died on or after January 1, 2002, a will contest must be filed within three months of the certificate’s filing.
