FORM 13.8 - APPLICATION AND ENTRY TO EXTEND ADMINISTRATION. This form is used in the Probate Court of Stark County, Ohio, when a fiduciary (executor or administrator) needs more time to complete the administration of an estate beyond the standard six-month period. Under R.C. 2109.301 and Sup. R. 78(B) and (C), Ohio law generally requires estates to be settled within six months unless an extension is granted for valid reasons. This form allows the fiduciary to explain why closing the estate within the standard timeframe would be detrimental to the estate or its beneficiaries. Common reasons for requesting an extension include unresolved creditor claims, pending litigation, real estate sales, tax issues, or the need for additional time to locate heirs or assets. If the court approves the request, it will set a new deadline for filing the final account or certificate of termination—often extending it to 13 months after the fiduciary's appointment. If the request is denied, the fiduciary must comply with the original timeline.
