Description

IW-1610 - PETITION FOR PROTECTION OR SERVICES (CHAPTER 48) INDIAN CHILD WELFARE ACT. This form is used to request court intervention in a case involving a child who may be in need of protection or services under Chapter 48 of the Wisconsin Statutes and who is also subject to the federal Indian Child Welfare Act (ICWA). The petition is submitted to the Circuit Court by a district attorney, corporation counsel, or other authorized petitioner, and includes detailed personal and tribal information about the child, parents, and other relevant parties. The petitioner must provide evidence that the child is within the court’s jurisdiction, has tribal affiliation, and is in need of protection or services for specific legal reasons. If the child has been removed from the home, the petitioner must explain why continued custody with the parents or Indian custodian is likely to result in harm, confirm that active and reasonable efforts were made to preserve the family unit, and state why in-home placement is not currently in the child's best interest. The form includes information about custody, removal, and services provided, and requests that the court adjudicate the child and issue an appropriate dispositional order. The Uniform Child Custody Jurisdiction Act Declaration must also be submitted with this petition. §§48.13 and 48.255, Wisconsin Statutes. www.FormsWorkflow.com
