Description

P-1.0110 - ORDER TO OPEN SAFE DEPOSIT BOX, ADJUDGED. This form is used in a probate case in the Circuit Court of a specific county in Florida to authorize the petitioner (the person making the request) to open and examine the contents of a safe deposit box that was leased or coleased to the deceased individual mentioned in the form. The petitioner must have satisfactory proof of the decedent's death and must be entitled to the benefits provided under Florida Statutes section 655.935, which pertains to accessing safe deposit boxes after a person's death. The order directs the lessor (the entity that owns or operates the safe deposit box facility) to allow the petitioner to open the safe deposit box in the presence of an officer of the lessor. The purpose of this provision is to ensure the process is properly supervised and documented. The officer of the lessor who accompanies the petitioner during the opening of the safe deposit box must make a complete copy of any document removed and delivered. The copy, along with a memorandum of delivery containing relevant details, should be placed back in the safe deposit box. The lessor is allowed to charge a reasonable fee to cover the costs associated with complying with this order. The specific fee amount is not provided and may vary depending on the lessor's policies. The order is issued and signed by a Circuit Judge, indicating the court's approval and authorization to open the safe deposit box. Bar Form No. P-1.0110 Florida Lawyers Support Services, Inc.
