Description

P-1.0800 - NOTICE OF TRUST. This form is used in a probate case in the Circuit Court of a specific county in Florida to notify interested parties that a trust exists related to the estate of a deceased individual. The notice states that the deceased, identified as a resident of the specified county, was the settlor of a trust. It includes the name of the trust and the date it was established. The notice explains that it is a trust described in Florida Statutes section 733.707(3) and is liable for the expenses of the administration of the decedent's estate and enforceable claims of the decedent's creditors to the extent the decedent's estate is insufficient to pay them, as provided in Florida Statutes section 733.607(2). The notice specifies that the clerk shall file and index this notice of trust in the same manner as a caveat, unless there exists a probate proceeding for the settlor's estate in which case this notice of trust must be filed in the probate proceeding and the clerk shall send a copy to the personal representative.
