Description

P-1.0300 - CAVEAT BY CREDITOR (Nonresident—Pro Se). This form is used in the Circuit Court for a specific county in Florida for the purpose of filing a Caveat by Creditor in an estate probate case. The form is specifically intended for nonresident creditors who are representing themselves without an attorney (pro se). The caveator, who is a creditor of the deceased individual named in the form, states their interest in the estate and provides information about the deceased's last known residence address, social security number (if known), and year of birth (if known). The caveator also provides their own name, mailing address, and residence address. Since the caveator is not represented by an attorney, they designate a resident of Florida who is a member of The Florida Bar as their agent for the service of notice. The agent's name, mailing address, and residence address are provided in the form. The caveator consents that service of notice on the agent will bind them. The caveator requests that the clerk of the court notify their designated agent in writing about the issuance of letters of administration, as well as provide the names and addresses of the personal representative and the personal representative's attorney. The caveator also requests to be given any additional notice required by the Florida Probate Rules. The form includes a declaration under penalties of perjury and provides spaces for the caveator's signature and the agent's acceptance. Bar Form No. P-1.0300 Florida Lawyers Support Services, Inc.
