Form PC 110 - PETITION AND EX PARTE ORDER FOR TRANSPORT AND/OR TEMPORARY DETENTION. This form is used in Michigan in urgent public health situations when there is reason to believe that a person is a carrier of an infectious disease and poses a threat to others. A local health officer or department representative files the petition, supported by an affidavit, requesting that the individual be taken into protective custody and transported to a designated medical facility for observation, examination, testing, diagnosis, treatment, or short-term detention. Because emergencies require quick action, the order may be issued ex parte, meaning without the individual present at the time it is granted. Once signed by the judge, the order authorizes law enforcement, public health officers, or department representatives to transport the individual to the facility and ensures that they are provided with notice of the petition and order at the time of apprehension or detention. The individual may be held temporarily, generally for up to 72 hours (excluding weekends and holidays), until a court hearing can be held to decide if continued detention is necessary.
