Form PC 106 - ORDER FOLLOWING HEARING ON PETITION FOR TREATMENT OF INFECTIOUS DISEASE. This form is used in Michigan when a petition has been filed claiming that an individual is carrying an infectious or communicable disease and poses a health threat to others. After a hearing, the judge uses this form to record the findings and issue an official order on how the situation should be addressed. The court considers whether there is clear and convincing evidence that the person is a carrier, whether they have failed to comply with health warnings, or whether emergency circumstances required immediate action. Based on the evidence and recommendations of a review panel, the court may order various outcomes. These can include requiring the individual to participate in education, counseling, or treatment programs, undergo medical testing, appear before health officials for monitoring, stop certain harmful behaviors, live in a supervised setting, or—if necessary—be committed to a treatment facility for up to six months.
