Form PC 104 - PETITION FOR TREATMENT OF INFECTIOUS DISEASE. This form is used in Michigan when public health officials, such as a local health officer or department representative, believe that an individual is a carrier of a serious communicable disease and poses a health threat to others. This form allows the petitioner to formally request court intervention when the individual has failed or refused to comply with a written warning notice from health authorities or when their actions demonstrate a substantial risk of spreading the disease. Through the petition, the court is asked to hold a hearing to determine whether the individual should be ordered to take specific actions to reduce the health risk. These actions may include participating in education, treatment, or counseling programs, undergoing medical tests, ceasing conduct that places others at risk, living in a supervised setting, or, in more serious cases, being committed to a treatment facility. The petition must detail the facts and behaviors showing how the individual’s conduct creates a danger to others and why less restrictive steps have not been successful in controlling the risk.
