Order Following Hearing On Petition To Continue Temporary Detention {PC 112}

Form PC 112 - ORDER FOLLOWING HEARING ON PETITION TO CONTINUE TEMPORARY DETENTION. This form is used in Michigan when a person has been placed under emergency temporary detention due to concerns that they may pose a health threat to others because of an infectious disease. Initially, a local health officer or department representative files a petition claiming that an emergency exists, and the court may issue an ex parte order to detain the individual right away. This form is then used after a hearing to determine whether that detention should continue. Through this order, the judge records the court’s findings—such as whether proper notice was given, the facility where the individual is being held, and whether there is enough evidence to justify continued detention. Depending on the outcome, the judge may order that the person remain temporarily detained in a facility while a formal petition for treatment is processed, or state that the person must be released within five days if no petition is filed.
