eDiscovery Master Select Form (Request For eDiscovery Special Master Select)

REQUEST FOR eDISCOVERY SPECIAL MASTER SELECT. This form is used to request the selection of an eDiscovery Special Master in the context of arbitration or litigation. The form includes information about the termination of AAA authority, exclusion of liability, and refunds. The eDiscovery Special Master Select service concludes with the provision of the list of eDiscovery Special Masters. The AAA's services do not include handling the fees charged by the eDiscovery Special Master, inviting the eDiscovery Special Master to serve, performance-related matters, conflict checks and disclosures, scheduling, award-related matters, or any other issues that might arise during the proceeding. The form also includes an exclusion of liability section that states that neither the AAA nor any eDiscovery Special Master is a necessary or proper party in judicial proceedings related to the parties' arbitration, litigation, or the provision of services under the AAA's eDiscovery Special Master Select. The parties also agree that neither the AAA nor any eDiscovery Special Master shall be liable to any party in any action for damages or injunctive relief for any act or omission in connection with the parties' arbitration, litigation, or the provision of AAA's eDiscovery Special Master Select. The parties further agree not to call the eDiscovery Special Master, the AAA, or AAA employees as a witness in litigation or any other proceeding relating to the matter for which the AAA's eDiscovery Special Master Select has been utilized. Finally, the form includes information about refunds. There is a minimum non-refundable search fee of $750.
