AOC-E-210 - STANDBY GUARDIAN’S PETITION FOR APPOINTMENT AS GUARDIAN OF THE PERSON; GENERAL GUARDIAN FOR MINOR. This form is used in the state of North Carolina by an individual who has been previously designated as a standby or alternate standby guardian for a minor and is now seeking formal court appointment as either guardian of the person or general guardian. Filed in the Superior Court Division before the Clerk, this petition becomes relevant when the biological or adoptive parent (or a current guardian) who made the standby designation has become incapacitated, debilitated, deceased, or has consented in writing to the standby guardianship taking effect. The petitioner must provide supporting documentation for one of these triggering events, list the minor’s current residence, and disclose any other interested parties, including the non-designating biological parent and others with legal interest in the child’s welfare. If the petitioner seeks to be appointed as a general guardian (with authority over both personal and financial matters), they must also disclose the minor’s assets, liabilities, and income. This form allows the court to review whether the conditions for the standby guardianship have been met and ensures all interested parties are notified or have waived their right to notice.
