Description

AOC-E-203A - AFFIDAVIT FOR COLLECTION OF PERSONAL PROPERTY OF DECEDENT (For Decedents Dying On Or Before Dec. 31, 2011). This form is used in North Carolina to allow a simplified process for handling a deceased person’s estate without formally opening a full probate proceeding. This form is applicable when the decedent passed away on or before December 31, 2011, and the total value of their personal property, after deducting liens and encumbrances, does not exceed certain thresholds—typically $10,000, or up to $30,000 in cases involving a surviving spouse who is the sole heir or devisee. The form may be used whether the decedent had a will (testate) or did not (intestate), and at least 30 days must have passed since the death. It is completed by an eligible person, such as an heir, executor, devisee, public administrator, or creditor, who must affirm that no personal representative has been appointed or is pending. The affiant must also provide a list of all individuals entitled to inherit and submit a detailed inventory of the decedent’s personal property and assets. Once filed and notarized, this affidavit gives the named individual legal authority to collect and administer the decedent’s personal property in accordance with North Carolina law under G.S. Chapter 28A, Article 25. G.S. 28A-25-1; 28A-25-1.1. www.FormsWorkflow.com
