AOC-E-905 - APPLICATION FOR PROBATE AND PETITION FOR SUMMARY ADMINISTRATION; AND ADDENDUM (AOC-E-309). This form is used in North Carolina when a surviving spouse seeks to settle the estate of a deceased person through a simplified process known as summary administration. This option is only available when the surviving spouse is both the sole heir and sole devisee under the decedent’s will. By using this form, the applicant requests the court to admit the decedent’s will to probate and to authorize the distribution of the estate without the appointment of a personal representative. The form requires the applicant to affirm several facts under oath, including that the decedent was domiciled in the county at death, that there are no other heirs or devisees, that the will allows summary administration, and that the applicant will assume all debts, liabilities, and tax obligations of the estate. It also includes an inventory of the decedent’s assets—such as bank accounts, real estate, personal property, and other financial interests—and identifies property that may be added to the estate if needed to pay claims.
