Description

AOC-E-201 - APPLICATION FOR PROBATE AND LETTERS. This form is used in North Carolina to begin formal probate proceedings and request the court to issue authority for someone to manage a deceased person’s estate. This form is filed with the Clerk of Superior Court when a decedent has left a will and the applicant is seeking to probate the will and be officially appointed as executor (or administrator with the will annexed, if the named executor is unable or unwilling to serve). The applicant must affirm that the decedent was domiciled or held property in the county, that there is no other pending probate proceeding, and that they are eligible and not disqualified from serving. The form includes essential information about the decedent, their will, and the heirs or beneficiaries. It also requires a preliminary inventory of the estate’s assets, such as bank accounts, real property, personal belongings, and potential income or claims, to help the court determine the estate’s scope and value.
