AOC-E-199 - APPLICATION FOR PROBATE (WITHOUT QUALIFICATION OF A PERSONAL REPRESENTATIVE). This form is used in North Carolina to formally request the probate of a decedent’s Last Will and Testament without appointing a personal representative, such as an executor or administrator, to manage the estate. This application is typically filed when the will needs to be legally recognized and recorded by the court, but no further administration is necessary—often because there are no significant assets to distribute through the estate or because assets pass directly to heirs outside of probate. The applicant must affirm that the decedent was domiciled in the county at the time of death or owned property there, and must meet specific criteria—such as being a named devisee in the will or an interested party—especially if the named executor has not yet applied for probate.
