AOC-E-202 - APPLICATION FOR LETTERS OF ADMINISTRATION. This form is used in North Carolina when a person dies without a will (intestate) or when no executor is named or available to administer the estate. Filed with the Superior Court Clerk, this form initiates the probate process and requests the court to appoint the applicant as the personal representative (administrator) of the decedent's estate. The applicant must state that the decedent was domiciled in the county, left property there, or was a nonresident motorist who died in North Carolina, and must affirm that no other probate proceeding is pending elsewhere. The form requires information about the decedent, including their date and place of death, and identifies all individuals entitled to inherit from the estate. The applicant must confirm they are not disqualified under state law from serving as administrator and that they have a legal right to apply or that others with prior right have renounced. The form also includes a Preliminary Inventory, listing the decedent’s assets, such as bank accounts, property, vehicles, and investments, and indicates any jointly owned property or non-probate assets that may be available to pay claims if needed. Additionally, the applicant must disclose whether any real estate is owned jointly with a spouse, if there are payable-on-death benefits, or if a wrongful death claim is possible. Once signed and sworn before a notary or court official, the court may issue Letters of Administration, authorizing the applicant to collect and manage the decedent’s assets, pay debts, and distribute the estate according to North Carolina’s intestate succession laws.
