AOC-E-432 - APPLICATION FOR ADMINISTRATION BY CLERK (Not To Exceed $5,000). This is a simplified probate form used in the state of North Carolina under G.S. 28A-25-6. This form allows an heir, creditor, or person who paid funeral expenses to request that the Clerk of Superior Court collect and administer up to $5,000 in assets belonging to a deceased individual when no formal estate has been opened. It is intended for small estates in which the total amount owed to the decedent does not exceed $5,000, and no administrator has been appointed. The applicant must provide information about the decedent, their date of death, marital status, any surviving spouse, and heirs, as well as details about the assets, such as bank accounts and uncashed checks. The form also requires a listing of funeral expenses, including who paid them, and any outstanding debts. Once submitted, the Clerk may authorize the collection and distribution of funds, allowing for the payment of funeral costs and other valid claims without requiring the appointment of a personal representative or the opening of a full estate.
