Description

LACIV 107, APPLICATION AND ORDER TO SERVE SUMMONS BY POSTING FOR UNLAWFUL DETAINER. This form is used in the Los Angeles County Superior Court in an unlawful detainer action to request permission from the court to serve the summons on the defendant (the tenant) by posting it on the property where the defendant resides. An unlawful detainer action is a lawsuit brought by a landlord to evict a tenant who has violated the terms of their lease or rental agreement or who has failed to pay rent. The summons is the document that formally notifies the defendant of the lawsuit and the hearing date. In some cases, it may be difficult to personally serve the summons on the defendant, for example, if the defendant is avoiding service or cannot be located. The Application and Order to Serve Summons by Posting for Unlawful Detainer form requires the landlord to provide information about the defendant and the property, including the address and a description of the property. The landlord must also explain why they believe the defendant cannot be personally served and must provide any supporting evidence. If the court approves the application, it will issue an order allowing the landlord to serve the summons by posting it on the property where the defendant resides. The order will also specify the method and timing of the posting, as well as the date of the hearing. LASC Approved 10-03, Code Civ. Proc., § 415.45. www.FormsWorkflow.com
