Description

LACIV 131, COMMISSION. This form is used by the Superior Court of the State of California for the County of Los Angeles to authorize the deposition of a witness who is located outside of California, but within the United States, its territories, or insular possessions. The purpose of the commission is to allow the oral examination of a witness to be conducted outside of California, but still under the jurisdiction of the California court, while ensuring that the deponent will be required to attend and comply with the obligations to produce documents and answer questions. The commission specifies that the deposition must be conducted under the supervision of a person who is authorized to administer oaths by the laws of the United States or the place where the examination is to be held, and who is not otherwise disqualified under California Code of Civil Procedure section 2025(k) or section 2025(l)(B)(2). Alternatively, the deposition may be conducted before a person appointed by the Court to administer oaths and take testimony, but only until a specified date.
