Description

LACIV 106, APPLICATION AND ORDER REGARDING LOST WRIT. This form is used to request a replacement writ of execution when the original writ has been lost, stolen, or destroyed. A writ of execution is a court order that authorizes the enforcement of a judgment by allowing a sheriff or other law enforcement officer to seize property or assets belonging to the judgment debtor in order to satisfy the judgment. If the original writ of execution is lost or destroyed, the judgment creditor (the person who won the lawsuit and obtained the judgment) may need to request a replacement writ in order to enforce the judgment. The Application and Order Regarding Lost Writ form requires the judgment creditor to provide information about the original writ, including the the date of issuance. The form also requires the creditor to certify that they have made a diligent search for the original writ. If the court approves the application, it will issue an order directing the issuance of a replacement writ of execution. The judgment creditor can then use the replacement writ to enforce the judgment in the same manner as the original writ. LASC Approved 09-04 Code Civ. Proc., § 712.010 et seq. www.FormsWorkflow.com
