General Form 19 - PETITION FOR TRANSFER OF PROCEEDING CONCERNING AN INDIAN CHILD. This form is used in New York Family Court to request that jurisdiction over a child welfare case involving a Native-American (Indian) child be transferred to the child’s tribal court or nation. The form applies to various proceeding types, including foster care placement, child abuse or neglect, termination of parental rights, PINS, destitute child, surrender, adoption, or custody to a non-parent. The petitioner—who may be a parent, Indian custodian, tribal representative, or local social services commissioner—must identify the child, confirm tribal membership or eligibility, and specify whether the tribe has exclusive jurisdiction (if the child resides on tribal land or is a ward of the tribal court). The petitioner must also indicate whether the tribe or nation consents to the transfer or has taken a position on the request.
