DR-211 - ORDER REGARDING DILIGENT INQUIRY AND NOTICE. This form is used in the Superior Court of Alaska in cases where a petitioner is seeking a dissolution of marriage and the other spouse cannot be located. The form documents the court’s review of the petitioner’s affidavit detailing efforts to find the absent spouse and determines whether those efforts meet the legal standard of a "diligent inquiry." If the court finds the inquiry insufficient, it directs the petitioner to take additional steps to locate the spouse. If the inquiry is deemed sufficient, the court authorizes notice to be given by alternative means—typically by posting the Notice to Absent Spouse on the Alaska Court System’s website for four consecutive weeks. The petitioner is also required to send copies of the notice and the petition for dissolution via certified and regular mail to the last known address of the absent spouse. The form may also direct other forms of public notice, if necessary. Once notice has been given, the petitioner must complete and file a notarized Proof of Notice form. AS 25.24.220(c).
