Description

PCT/IPEA/425, NOTIFICATION OF CANCELLATION OF CERTAIN ELECTIONS (PCT Article 31(4)(a) and Administrative Instruction, Section 606). This form is a notification issued by the International Preliminary Examining Authority (IPEA) under the Patent Cooperation Treaty (PCT). This notification concerns the cancellation of certain elections made by the applicant under PCT Article 31(4)(a) and Administrative Instruction, Section 606 during the international preliminary examination (IPE) process. PCT Article 31(4)(a) and Administrative Instruction, Section 606 allow the applicant to elect not to have certain claims searched or not to have certain claims examined in the international preliminary examination report (IPER). However, if the claims were found to be related to other claims in the international application that have been searched or examined, the election can be canceled. The notification PCT/IPEA/425 is typically issued by the IPEA to inform the applicant and the International Bureau (IB) that certain elections made by the applicant have been canceled during the IPE process. The notification will specify the reasons for the cancellation of the election, and may also provide information on how the canceled claims will be dealt with in the IPER. It is important to note that the cancellation of an election does not necessarily mean that the canceled claims will be searched or examined in the IPER. The IPEA will determine the appropriate course of action based on the specific circumstances of the case and the relevant provisions of the PCT and the applicable national and regional laws. www.FormsWorkflow.com
