General Form GF-40 - PETITION FOR MODIFICATION OF ORDER OF CUSTODY OR VISITATION – FAMILY OR SUPREME COURT. This form is used in the New York Family Court to request a change to an existing custody or visitation order issued by either the Family Court or the Supreme Court. The petitioner—who may be a parent, guardian, or other qualified party—must identify the prior order, explain the change in circumstances since the original judgment, and describe how the modification would serve the best interests of the child.
