Description

SDSC CIV-359 - STIPULATION TO USE ALTERNATIVE DISPUTE RESOLUTION (ADR). This is a San Diego Superior Court form used when parties agree to submit a civil case to mediation, arbitration, or another ADR process. The form allows parties to select from several ADR options, including court-connected mediation, private mediation, binding or non-binding private arbitration, judicial arbitration, neutral evaluation, or other agreed processes. The stipulation identifies the selected neutral and confirms that choosing ADR does not delay case management deadlines. If the matter settles, the parties must notify the court, which will place the case on a 45-day dismissal calendar. Court approval is required for the stipulation to become an order. Cal. Rules of Court, rule 3.1385. www.FormsWorkflow.com
