CM67 - ORDER TO SELL REAL ESTATE. This form is used by the Court of Chancery of the State of Delaware to grant a guardian legal authority to sell real property owned by a person with a disability or a minor. The order is issued after the court reviews and approves a petition that includes the proposed Agreement of Sale for the property. Once approved, the guardian is permitted to proceed with the sale in accordance with the terms outlined in the agreement. The order also authorizes the guardian to pay the individual’s share of Delaware transfer tax, closing costs, and contribute a specified amount toward the purchaser’s closing costs, if applicable. Additionally, the guardian must either deposit the proceeds into an existing guardianship account or open a new account titled in compliance with the court’s requirements, where withdrawals are only permitted by court order. The guardian is required to file a Return of Sale with the court within thirty days after the real estate transaction is finalized.
