Description

CM39 - FINAL ORDER TO ACCEPT TRANSFER OF FOREIGN GUARDIANSHIP (ACCOUNTINGS WAIVED) CO-GUARDIANS. This form is used by the Court of Chancery of the State of Delaware to approve and establish a guardianship within Delaware for both the person and property of an individual with a disability whose guardianship was originally granted in another state. After reviewing the petition and certified documentation from the foreign jurisdiction, the court appoints the named individuals as co-guardians, authorizing them to act jointly or independently. The order grants them the legal authority and responsibilities necessary to protect, manage, and care for the personal and financial interests of the individual in accordance with Delaware law (12 Del. C., Ch. 39). It requires the filing of a bond to ensure faithful performance of duties and outlines ongoing obligations such as submitting annual updates and medical reports, maintaining communication with the court upon events like Medicaid qualification or the individual’s death, and seeking court approval for major transactions involving the person’s property. While the guardians are relieved from opening a guardianship account and filing accountings unless significant income or assets are acquired, they must report any changes to the court. www.FormsWorkflow.com
