Description

PCT/IB/378, INVITATION TO CORRECT DEFECTS IN THE SUPPLEMENTARY SEARCH REQUEST (PCT Rules 45bis.4(a) and (d)). This form is used in the context of international patent applications filed under the Patent Cooperation Treaty (PCT). Specifically, it is an invitation from the International Searching Authority (ISA) to the applicant to correct any defects in the supplementary search request. PCT Rule 45bis.4(a) provides that the supplementary search request must be filed with the ISA within 22 months from the priority date of the application, and must contain certain information and elements, including a description of the invention, a list of the relevant documents, and an indication of the relevant technical field. PCT Rule 45bis.4(d) further provides that the ISA may invite the applicant to correct any defects in the supplementary search request within a specified time limit. If the ISA identifies any defects in the supplementary search request, it will issue an invitation to the applicant to correct them using the PCT/IB/378 form. The form requires the applicant to identify the specific corrections to be made and provide the necessary supporting documents. The corrected information and elements must be submitted within the time limit specified in the invitation. It is important for applicants to promptly and accurately respond to invitations to correct defects in the supplementary search request, as failure to do so may result in the ISA being unable to carry out the supplementary search or in the application being considered withdrawn or deemed not to have been filed. www.FormsWorkflow.com
