Description

PETITION FOR DISCRIMINATION BENEFITS PURSUANT TO LABOR CODE SECTION 132a. An employee can file with the California Workers' Compensation Appeals Board to seek compensation for discrimination or retaliation by their employer as a result of filing a workers' compensation claim or exercising their rights under California workers' compensation laws. Under California law, employers are prohibited from discriminating or retaliating against employees who file workers' compensation claims or exercise their rights under workers' compensation laws. If an employer takes adverse action against an employee for such reasons, the employee may be entitled to additional compensation beyond what is available through the standard workers' compensation system. Examples of discrimination or retaliation by an employer may include demotion, termination, reduced hours or pay, or other adverse actions taken against the employee as a result of filing a workers' compensation claim or exercising their rights under workers' compensation laws. To file a Petition for Discrimination Benefits pursuant to Labor Code Section 132a, an employee must provide evidence of their injury or illness, as well as evidence of discrimination or retaliation by their employer. The employee may also need to provide testimony or other evidence to support their claim. It is recommended that individuals seeking to file this type of petition consult with an experienced workers' compensation attorney to ensure that their rights are protected and their claim is properly prepared and presented. www.FormsWorkflow.com
