28.030 Gifts; Delivery of Personal Property to Third Person; Recovery Delivery, actual or constructive, being essential to a valid gift, if the owner of personal property should deposit it with another who is directed by the owner to deliver it to a third person as a gift from the owner, the owner could at any time before actual delivery to the intended donee and acceptance of the gift by the donee recover the property from the person with whom it had been deposited for delivery.
