FORM DC-418 - AFFIDAVIT – DEFAULT JUDGMENT SERVICEMEMBERS CIVIL RELIEF ACT. This form is used in Virginia courts to comply with federal and state laws that protect active-duty military members in civil legal proceedings. Before a default judgment can be entered against a defendant or respondent who fails to appear in court, the plaintiff or petitioner must file this affidavit to state whether the other party is currently serving in the military. The form includes a declaration of the defendant’s military status, the basis for that determination, and may require supporting facts. If the court cannot determine the person’s military status, it may require a bond before entering judgment. The form also allows for the appointment of legal counsel to represent an absent servicemember and outlines how attorney fees may be handled.
