FORM DC-451- GARNISHMENT SUMMONS This is a court form used in the Commonwealth of Virginia under Virginia Code §§ 8.01-511 and 8.01-512.3. It is issued by a General District Court to enforce a judgment by garnishing a debtor’s wages or other assets. This form is used when a creditor (the “judgment creditor”) has obtained a money judgment against a debtor (the “judgment debtor”) and seeks to collect what is owed by targeting money or property in the hands of a third party (the “garnishee”), such as an employer or a bank. The summons instructs the garnishee to either submit a written response, pay funds into the court, or appear in court on a scheduled date to respond to the creditor’s request for garnishment. The garnishee is directed to withhold funds owed to the debtor, up to the total balance due listed on the form, and depending on the nature of the debt—such as wages, taxes, or support obligations—certain legal limits apply to how much can be withheld. Employers with 1,000 or more employees are allowed reasonable time to process garnishments through their normal payroll systems.
