Description

F 5010-1.1.ORDER.REOPEN.CERT - ORDER ON MOTION IN A CHAPTER 7 OR 13 CASE (1) TO REOPEN CASE AND (2) FOR EXTENSION OF TIME TO FILE FORMS REQUIRED FOR DISCHARGE [LBR 5010-1]. This form is used in the United States Bankruptcy Court for the Central District of California when a debtor in a Chapter 7 or Chapter 13 bankruptcy case seeks to reopen a previously closed case. The case may have been closed without the debtor receiving a discharge due to failure to timely file required documentation, such as the Certificate of Debtor Education or the Debtor’s Certification of Compliance. These forms are essential to demonstrate that the debtor has completed the necessary financial management education or fulfilled other statutory obligations for discharge eligibility. Through this motion, the debtor requests the court to reopen the case under 11 U.S.C. § 350(b) and Federal Rule of Bankruptcy Procedure 5010, and to grant additional time to submit the missing forms. If granted, the case is reopened, no trustee is appointed unless ordered otherwise, and the debtor is given a 30-day window to file the required forms. If the debtor complies within the given time, a discharge will be entered, and the case will be closed. If not, the case will close again without a discharge. This form is mandatory. It has been approved for use by the United States Bankruptcy Court for the Central District of California. www.FormsWorkflow.com
