Description

F 5010-1.1.MOTION.REOPEN.CERT - MOTION IN A CHAPTER 7 OR 13 CASE (1) TO REOPEN CASE AND (2) FOR EXTENSION OF TIME TO FILE FORMS REQUIRED FOR DISCHARGE [LBR 5010-1; 9013-1(q)(11)]. This form is used in the United States Bankruptcy Court for the Central District of California when a debtor seeks to reopen a previously closed bankruptcy case. The form is used in Chapter 7 or Chapter 13 cases where the court closed the case without granting a discharge because the debtor failed to file necessary forms—such as the Certificate of Debtor Education or the Debtor’s Certification of Compliance—by the required deadline. The debtor uses this motion to request that the court reopen the case under 11 U.S.C. § 350(b) and extend the deadline to file the required forms by 30 days, enabling the debtor to obtain a discharge. The form requires the debtor to explain why the forms were not filed on time and includes a declaration under penalty of perjury, as well as a section for proof of service to show that all necessary parties were notified according to court rules. This form is mandatory. It has been approved for use in the United States Bankruptcy Court for the Central District of California. www.FormsWorkflow.com
