CRM-327 - PETITION FOR DISMISSAL – PETITION (PEN. CODE, § 1203.4b). This form is used in the Superior Court of California, County of San Diego by a defendant in a criminal case to request the dismissal of charges under Penal Code section 1203.4b. This section allows for the dismissal of charges and the setting aside of a conviction if the defendant has successfully participated in certain rehabilitation or work programs while incarcerated. Specifically, the form is for individuals who have successfully participated in either: • The California Conservation Camp Program as an incarcerated individual hand crew member. • An institutional firehouse operated by the California Department of Corrections and Rehabilitation (CDCR). • A county incarcerated individual hand crew. The form requires the petitioner to provide specific information about their participation in these programs, as well as their current status in terms of probation, parole, or supervised release. The form also includes a request to withdraw the plea of guilty or nolo contendere or to set aside a verdict or finding of guilt and enter a plea of not guilty. The petitioner is responsible for providing 15 calendar days' notice of the filing of the petition to the prosecuting agency.
